Clinic & Program Terms and Conditions — Last updated: September 2026
These Terms and Conditions apply to football clinics, coaching sessions, programs and other activities provided by Brillante Football Academy Pty Ltd (“BFA”, “we”, “us” or “our”).
By registering a participant for a BFA program, the parent or legal guardian making the booking agrees to these Terms and Conditions.
A participant’s place is not confirmed until the registration process has been completed and any required payment has been received.
The person completing the registration confirms that they are the participant’s parent/legal guardian or otherwise have authority to register the participant and provide the required consents.
Parents/guardians are responsible for ensuring information supplied during registration is accurate and current.
Parents/guardians must provide BFA with any information reasonably necessary for the safe participation of their child, including relevant medical conditions, allergies, injuries, medications, disabilities or additional support requirements, and other health or safety considerations.
Parents/guardians should notify BFA if relevant information changes before or during a program.
Program fees are payable at the time specified during registration.
Where online payments are processed through a third-party payment provider, that provider may process payment information in accordance with its own terms and privacy practices.
Any applicable booking or transaction fees will be disclosed during the booking process.
Cancellation and refund conditions applicable to a particular clinic or program will be displayed during registration.
Unless otherwise stated for a particular program:
More than 7 days before commencement: A cancellation may receive a refund of the program fee, less any clearly disclosed and reasonable non-refundable transaction or administrative costs.
Within 7 days of commencement: BFA may offer a credit toward another BFA clinic or program rather than a refund, subject to availability and the circumstances of the cancellation.
After the program has commenced or for non-attendance: Refunds are generally not provided for missed sessions or changes of mind. BFA may consider illness, injury, family emergencies or other exceptional circumstances on a case-by-case basis.
Nothing in this section limits any rights a customer may have under the Australian Consumer Law.
BFA may reasonably cancel, postpone, relocate or reschedule a clinic or session because of circumstances including severe or unsafe weather, unsafe playing conditions, ground closures, coach illness or unavailability, insufficient participant numbers, emergency situations, or circumstances outside BFA’s reasonable control.
Where reasonably practicable, BFA will notify affected parents/guardians as soon as possible.
Where BFA cancels a program and does not provide a reasonable replacement or rescheduled service, participants will be offered an appropriate refund or credit, subject to rights available under Australian Consumer Law.
Football programs may continue in light rain where conditions are considered safe.
BFA may modify, delay, relocate, shorten, postpone or cancel activities where weather or playing conditions create an unreasonable safety risk. This may include excessive heat, storms, lightning, heavy rain, poor air quality or unsafe playing surfaces.
Parents/guardians should monitor BFA communications before attending when adverse weather is expected.
Parents/guardians are responsible for ensuring participants arrive at the correct location and are appropriately supervised until the applicable BFA check-in process has occurred.
Participants must be collected promptly at the scheduled completion time.
Parents/guardians should advise BFA where another authorised adult will be collecting their child if required by BFA’s collection procedures.
BFA should be informed as soon as possible if a parent/guardian will be unexpectedly delayed.
BFA aims to provide a safe, positive and respectful football environment.
Participants are expected to follow reasonable instructions from BFA coaches, respect other participants, staff, officials and facilities, refrain from bullying, harassment, discrimination or abusive behaviour, use equipment appropriately, and avoid conduct that creates an unreasonable safety risk.
BFA may temporarily remove a participant from an activity where reasonably necessary for safety or behaviour management.
For serious or repeated misconduct, BFA may contact the parent/guardian and require the participant to be collected.
Any decision regarding continued participation will take into account the circumstances and seriousness of the behaviour.
Participants should arrive wearing appropriate sporting clothing and footwear and bring any equipment specified by BFA.
Participants should bring sufficient drinking water and appropriate sun protection for outdoor activities.
BFA is not responsible for loss or damage to personal belongings except to the extent that responsibility cannot lawfully be excluded.
By registering a participant for a BFA program, the parent/guardian making the booking authorises BFA to provide or arrange reasonable first aid for the participant where required.
Where urgent medical attention is reasonably considered necessary, BFA may contact emergency services or arrange urgent medical treatment, including where the parent/guardian cannot reasonably be contacted.
BFA will attempt to contact the participant’s parent/guardian or nominated emergency contact as soon as reasonably practicable.
By agreeing to these Terms and Conditions, parents/guardians confirm this medical and emergency authorisation.
By registering a participant for a BFA program, the parent/guardian making the booking consents to that participant taking part in BFA football activities, including all clinics, sessions and programs they are registered for.
Football and physical activity involve inherent risks, including falls, collisions and sporting injuries.
By agreeing to these Terms and Conditions, parents/guardians acknowledge and accept these inherent risks on behalf of the participant.
BFA will take reasonable steps to provide an appropriately managed environment.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory right or liability that cannot lawfully be excluded, restricted or modified.
Photography and video for BFA promotional or marketing purposes will be managed according to the photography/video consent selected by the participant’s parent/guardian during registration.
Declining promotional media consent does not prevent a child from participating in a BFA program.
BFA will take reasonable steps to avoid deliberately publishing identifiable promotional images or video of participants whose parent/guardian has declined consent.
BFA’s name, logos, branding, coaching materials, program materials, graphics, photographs and other content owned by BFA must not be commercially reproduced or used without permission, except where permitted by law.
This provision does not claim ownership of photographs or material belonging to participants or third parties.
Personal information collected in connection with BFA programs will be handled in accordance with BFA’s Privacy Policy and applicable Australian privacy requirements.
BFA may make reasonable changes to coaches, session structures, activities, locations or schedules where necessary.
Where a material change significantly affects the service purchased, BFA will communicate available options to affected customers.
Nothing in these Terms is intended to exclude, restrict or modify rights or remedies that cannot lawfully be excluded under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law.
These Terms are governed by the laws of New South Wales, Australia.
